Arbitration and Mediation (Alternate Dispute Resolution)
Our
civil litigation system is simply is not the best
way to resolve all disputes. It is expensive, time-consuming,
intrusive, stressful and more. There are other ways
to resolve disputes, including private arbitration
and mediation. These are conducted far away from the
courtroom, are significantly more user-friendly and
are generally far more cost-effective and efficient.
As Christians, we should follow the Biblical mandates
to resolve our disputes amongst one another, and avoid
litigation, when possible.
Mediation is a structured process in which a neutral third
party assists the disputants in reaching a negotiated
settlement of their differences. The mediator encourages
open discussion of the issues and uses a variety
of skills and techniques to provide a forum within
which the disputants can construct their own agreement.
Mediation is a voluntary process that results in
a signed agreement which defines the future behaviour
of the parties. The mediator is not empowered to
render a decision. Most parties in conflict cannot
afford protracted litigation. They often lose any
apparent gains that they achieve in courts. Mediation
provides disputants with a less costly and time
- limited intervention. The main advantage to mediation
is that it empowers the parties to solve their own
problems in a fair and equitable manner.
Awareness International Ministries has trained mediators and
arbitrators and has created some unique forms of
alternative dispute resolution, known as peacemaking.
Mediation is a less costly alternative than litigation.
Additionally, there are the intangibles including
the feeling that you were able to take control of
solving your own problems, rather than surrendering
your life to lawyers, judges, bailiffs and clerks.
Churches, business organizations, married couples should contact
us for more information. It is estimated that one
or two four hour sessions will resolve most issues.
